MyPEV Rentals Liability Waiver, Release & Indemnification Agreement

1. Acknowledgment of Inherently Dangerous Activity I, the undersigned renter, acknowledge that the use of electric scooters, e-bikes, electric unicycles, and one-wheels (collectively "PEVs") is an inherently dangerous activity that carries risks. These risks include, but are not limited to: collisions with vehicles, pedestrians, or objects; falls due to uneven surfaces (e.g., cracks, curbs); equipment malfunction; weather conditions; and my own inability to operate the PEV. I voluntarily assume full responsibility for any and all risks, known or unknown, associated with the rental and use of MyPEV Rentals' equipment.

2. Release of Liability (Florida Negligence Waiver) I hereby release, waive, and discharge MyPEV Rentals, its owners, employees, affiliates, and agents from any and all claims, liabilities, damages, or injuries (including death) that may arise from my use of the rented PEVs. SPECIFICALLY: I understand that this release includes claims caused by the ORDINARY NEGLIGENCE of MyPEV Rentals (e.g., failure to inspect equipment, failure to warn of hazards). I am voluntarily releasing my right to sue MyPEV Rentals for its own negligence to the fullest extent permitted by Florida law (Sanislo v. Give Kids the World).

3. Renter Responsibilities & Compliance with Law

• Sobriety: I confirm I am not under the influence of alcohol or drugs. I understand that operating a PEV under the influence is illegal in Florida and constitutes a breach of this agreement.
• Local Laws (Jacksonville Ordinances): I agree to operate the vehicle in a safe and lawful manner. I acknowledge that Jacksonville City Ordinances may prohibit the use of PEVs on sidewalks in certain areas (such as the Downtown Central Business District). I agree to ride in bike lanes or on the road where required by law.
• Physical Capability: I confirm I am physically and mentally capable of operating the rented vehicle.
• Damage Liability: I acknowledge that I am responsible for any damage to the rented vehicle or loss of equipment during my rental period, regardless of fault.

4. Helmet & Safety Gear Acknowledgment I acknowledge that wearing a helmet and protective gear is strongly recommended.

• Florida Law Warning: I understand that under Florida Statute § 316.2065, riders under the age of 16 are required by law to wear a bicycle helmet.
• If I choose not to wear a helmet (and am over 16), I assume all increased risks of head injury or death.

5. Indemnification Agreement I agree to indemnify, defend, and hold harmless MyPEV Rentals from any claims, damages, judgments, or legal fees resulting from my actions while using the rented vehicle. This includes claims made by third parties (e.g., pedestrians, city property, other vehicles) due to accidents, injuries, or damages caused by my operation of the vehicle.

6. Rental Terms & Conditions

• I must return the vehicle in the same condition as received, subject to normal wear and tear.
• I authorize MyPEV Rentals to charge my credit card on file for any damages, theft, late fees, or loss of the vehicle/accessories.
• MyPEV Rentals reserves the right to terminate this rental immediately without refund if I am observed operating the vehicle unsafely.

7. Emergency Procedures In the event of an accident or malfunction, I agree to stop using the vehicle and notify MyPEV Rentals immediately. I understand I am responsible for seeking my own medical attention if necessary.

8. Severability & Governing Law This agreement shall be governed by the laws of the State of Florida. Any legal disputes will be resolved in the appropriate court within Duval County (Jacksonville), FL. If any portion of this agreement is found to be unenforceable by a court, the remaining sections shall remain in full force and effect.

MANDATORY NOTICE FOR MINOR PARTICIPANTS

(If the rider is under 18, a parent or guardian must sign. Florida Statute § 744.301 requires the following notice be exactly as it appears below)

NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF MyPEV RENTALS USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM MyPEV RENTALS IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND MyPEV RENTALS HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
